Effective Date: is the date you hire the bike
These Terms and Conditions govern the hire of bicycles, e-bikes and associated equipment from Mount Vernon Community Hall Cycle Hire Service ("the Provider", "we", "us" or "our").
By making a booking and signing these Terms and Conditions, you ("the Hirer", "you" or "your") agree to be bound by them.
Booking and Hire Agreement
Bikes and associated equipment may only be hired after the Hirer has completed and signed these Terms and Conditions. The signatory must be the named Primary Hirer and must produce the required identification documents.
A booking is made when the Hirer submits a completed booking form and payment. Upon acceptance of the booking by the Provider, a binding contract is formed between the Hirer and the Provider.
Where a booking is made on behalf of other riders, the person making the booking confirms that they have authority to accept these Terms and Conditions on behalf of all members of the party.
The hire period begins when the cycle(s) and equipment are collected and ends when they are returned to the designated return location.
You the Hirer accepts responsibility for ensuring that all users covered by the booking comply with these Terms and Conditions.
1. Your Responsibilities

You are responsible for ensuring that you are physically fit and capable of undertaking the intended cycling activity.

You acknowledge that cycling involves inherent risks, including the risk of injury, illness, property damage and death.

We strongly recommend that all riders wear a properly fitted cycle helmet. Helmets may be available for loan; however, riders remain responsible for ensuring that any helmet used fits correctly and is suitable for use. Riders are encouraged to bring their own helmets where possible.

You agree to ride responsibly and in accordance with all applicable laws, regulations and the Highway Code.

We recommend that you arrange suitable personal insurance covering accident, injury, personal belongings and third-party liability.

You are responsible for all cycles and equipment hired or loaned to you and must keep them safe from loss, theft, damage and misuse.

You must notify the Provider immediately of any loss, damage, accident or theft involving hired equipment.

You must not sell, hire out, lend, transfer or otherwise part with possession of any cycle or equipment.

No person under the age of 14 may ride an e-bike, in accordance with UK law.
-
You must not ride while under the influence of alcohol, illegal drugs, or medication that may impair your judgement or ability to ride safely.

You must:

Follow the Highway Code at all times.
-
Not ride on pavements unless permitted by law.
-
Not ride against traffic.
-
Not exceed two riders abreast where permitted.
-
Obey traffic signals and road signs.
-
Show consideration to pedestrians and other road users.
-
Ride within your own abilities and the intended capabilities of the bicycle.
-
Failure to comply with these responsibilities may result in additional charges and may invalidate any optional damage waiver or insurance arrangement.
2. Price and Payment

The full hire charge must be paid before the commencement of the hire period unless otherwise agreed.

All cycles, helmets, locks and other equipment must be returned to the designated return location unless alternative arrangements have been agreed in advance.

Additional charges may apply where equipment is returned to a different location without prior agreement.

Any unreturned items will be charged to the Hirer.
-
Where equipment is returned damaged, the Hirer shall be responsible for the reasonable cost of repair or replacement, whichever is lower.
-
Ordinary wear and tear resulting from normal use is included within the hire charge and will not be charged separately.
3. Identification Checks

Before any equipment is released, the Principal Hirer must provide:

One government-issued photographic identification document (passport or full driving licence); and
-
One proof of address dated within the last three months.

Failure to provide satisfactory identification may result in refusal of hire without liability on the part of the Provider.

Copies of identification documents may be retained where reasonably necessary for security, fraud prevention or contractual purposes and will be processed in accordance with our Privacy Notice and applicable data protection legislation.
4. Loss, Theft and Damage

The Hirer is responsible for all hired cycles and equipment during the hire period.

Charges may be applied for:

Loss;
-
Theft;
-
Damage;
-
Failure to return equipment;
-
Late return of equipment.

Late returns may incur additional hire charges calculated on a pro-rata basis according to the Provider's published hire rates.

Repair or replacement costs, insurance excesses and associated expenses may be charged to the Hirer.
-
The Hirer is fully responsible for any loss, theft or damage caused during the hire period, subject to any valid optional insurance or damage-waiver arrangement.
-
Repair or replacement charges will reflect the reasonable market cost of restoring or replacing the affected equipment.
-
Failure to pay legitimate charges may result in debt recovery proceedings and legal action.
5. Our Liability to You
Important Consumer Rights
Nothing in these Terms and Conditions excludes or limits liability for:

Death or personal injury caused by our negligence;
-
Fraud or fraudulent misrepresentation;
-
Any liability that cannot legally be excluded or limited under applicable law.

All cycles and equipment are inspected prior to hire.
-
You are responsible for carrying out a basic inspection of the cycle before use and informing us immediately of any defect or concern.

We will not be liable for loss or damage arising from:

Your own acts or omissions;
-
The acts or omissions of anyone in your party;
-
The actions of third parties beyond our reasonable control;
-
Events that could not reasonably have been foreseen or prevented;
-
Indirect or consequential losses.

Where we are unable to fulfil a confirmed booking due to circumstances within our control, our liability shall be limited to a refund of the amount paid for the affected hire.
6. Cancellation Policy
Payments are taken at the time of booking.
If you cancel your booking, the following refunds will apply:

24 hours to 6 days before hire

Less than 24 hours before hire or failure to attend
No refund
We may consider refunds outside these terms in exceptional circumstances at our sole discretion.
7. General

These Terms and Conditions constitute the entire agreement between the parties.

Any amendment must be agreed in writing.

A failure by either party to enforce a right shall not constitute a waiver of that right.
-
If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

Nothing in these Terms creates rights enforceable by third parties under the Contracts (Rights of Third Parties) Act 1999.

These Terms and Conditions shall be governed by the laws of Scotland.
-
Any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the Scottish Courts.
